Terms of Service

These Terms of Service govern your access to and use of FitUp, operated by Yehonatan Maliniak under the John Fit & Wellness brand (“FitUp,” “we,” “us,” or “our”). By creating an account or using FitUp, you agree to these Terms and the FitUp Privacy Policy. If you do not agree, do not use the service.

FitUp provides tools for personal trainers and trainees to create and manage workout and nutrition plans, log training and meals, record body weight and progress, manage trainer-client relationships, schedule appointments, synchronize eligible appointments with Google Calendar, and use AI-supported fitness and nutrition features.

Available features may depend on your role, approval, membership, trainer, and permissions.

You must have legal authority to accept these Terms. Users under 18 may use FitUp only with authorization and supervision from a parent or legal guardian and, where applicable, an approved trainer. A parent or guardian authorizing a minor’s account accepts responsibility for the minor’s use of FitUp.

You are responsible for:

• Providing accurate and current account information.
• Protecting your login credentials and account access.
• Activity performed through your account.
• Promptly reporting suspected unauthorized access.

You may not share access in a way that exposes another user’s personal information. FitUp may require email verification, trainer approval, or membership confirmation before enabling particular features.

FitUp supports a trainer-trainee relationship but does not replace a trainer’s professional judgment. Trainers are responsible for working within their qualifications, reviewing plans before assignment, protecting trainee confidentiality, and obtaining any consent required by law.

Trainees are responsible for providing relevant and accurate information and for communicating injuries, medical restrictions, dietary restrictions, and safety concerns to their trainer and appropriate healthcare professionals.

FitUp is a fitness, wellness, and administrative platform. It is not a medical service and does not provide diagnosis, treatment, or emergency assistance. Training, nutrition, body-weight, and progress information is for general informational and organizational purposes and is not a substitute for professional medical advice.

Consult a qualified professional before beginning or changing a workout or nutrition program, especially if you have an injury, medical condition, pregnancy, allergy, or dietary restriction. Stop exercising and seek appropriate assistance if you experience concerning symptoms. Do not use FitUp for an emergency.

AI Trainer, Chef, nutrition estimates, and other AI outputs may be incomplete, inaccurate, or unsuitable for a particular user. You must review AI-generated content before relying on it. Food values, portions, and exercise suggestions are estimates and must not be relied on for medical treatment, allergy management, or another high-risk decision. FitUp does not guarantee the accuracy of AI-generated content.

Users are responsible for reviewing information before saving it. Historical records may preserve a snapshot of workout information so past logs remain understandable when a program changes. Temporary plans may override regular plans during their configured effective dates. FitUp does not guarantee the accuracy of user-entered measurements, food information, or progress calculations.

FitUp may display appointment times, cancellation information, and administrative session prices. Unless expressly stated otherwise, payment arrangements, cancellation charges, refunds, and personal-training services are governed by the separate agreement between the trainer and trainee. FitUp does not currently process payment-card transactions.

Google Calendar connection is optional. By connecting it, you authorize FitUp to create, update, and delete FitUp appointment events as explained in the Privacy Policy. Your use of Google, Base44, Pexels, and other third-party services is also governed by their own terms and policies. FitUp is not responsible for a third party’s independent service or availability.

You retain ownership of information and content you submit. You grant FitUp a limited, non-exclusive license to host, copy, process, display, and transmit that content only as necessary to operate, secure, and improve user-facing FitUp functionality and comply with applicable law. You represent that you have the right to submit the content.

You must not:

• Access another user’s information without authorization.
• Misrepresent your identity, role, qualifications, or trainer relationship.
• Circumvent authentication, membership, or permission controls.
• Upload malicious code or interfere with FitUp’s operation.
• Exploit, scrape, or reverse engineer FitUp except where applicable law permits it.
• Use FitUp for unlawful, abusive, fraudulent, or harmful activity.
• Submit another person’s sensitive information without appropriate authority.

FitUp’s software, interface, branding, and original content belong to Yehonatan Maliniak or the applicable licensors. These Terms permit you to use FitUp for its intended purpose but do not transfer ownership or permit unauthorized use of FitUp’s branding or software.

FitUp may change, improve, suspend, or discontinue features. We aim to preserve important records and provide appropriate notice of material changes, but uninterrupted or error-free operation is not guaranteed.

Access may be restricted or terminated because of a violation of these Terms, unauthorized activity, a legal or security requirement, expired membership, withdrawal of trainer access, or discontinuation of the service. You may stop using FitUp and request account deletion at any time.

To the extent permitted by law, FitUp is provided on an “as available” basis and does not guarantee particular fitness, nutrition, health, or commercial results.

To the maximum extent permitted by applicable law, FitUp and its operator will not be liable for indirect, incidental, or consequential loss arising from use of the service, third-party services, user-entered information, or reliance on AI-generated content. Nothing in these Terms excludes a right or liability that cannot legally be excluded.

We may update these Terms when FitUp or applicable requirements change. The revised page will show a new effective date, and material changes will be communicated when required.

These Terms are governed by the laws of the State of Israel, without limiting mandatory consumer or privacy protections. Disputes will be handled by the competent courts in Israel unless applicable law requires otherwise.
